Terms of Use

These Terms of Use (the "Terms") set out the conditions under which safa.co (operated by Jin Kato; the "Operator") provides the mobile application "Mainichi JLPT" (the "App"). By using the App, the user is deemed to have agreed to these Terms.

Article 1 (Service description and non-affiliation)

The App is a study-aid application that helps users prepare for the Japanese-Language Proficiency Test (JLPT). The App is an independent study app and is not affiliated with, authorized by, or endorsed by Japan Educational Exchanges and Services (JEES), the Japan Foundation, or the official Japanese-Language Proficiency Test (JLPT). "JLPT" and related names are used only to describe the examination the App helps you prepare for. The App is intended as a learning aid and does not guarantee that you will pass the examination.

Article 2 (Scope)

These Terms apply to all relationships between the user and the Operator concerning use of the App. The App is available through the Apple App Store or the Google Play Store, and the respective terms of those stores also apply alongside these Terms.

Article 3 (Eligibility and age)

Users must meet the age rating and terms of the store from which the App is obtained. Minors should use the App (particularly where purchases are involved) only with the consent of a parent or legal guardian.

Article 4 (Accounts)

You may optionally create an account. You are responsible for managing your own account and login credentials and must not allow third parties to use them. You are responsible for damages arising from inadequate management of your credentials, misuse, or use by a third party. The Operator may restrict or suspend an account where unauthorized access or use is identified.

Article 5 (User-provided content and messages)

For information you enter or set — such as a nickname displayed in your profile — you must not use expressions that are offensive to others, that infringe third-party rights, or that violate laws or public order and morals. The Operator may delete or change content it deems inappropriate without prior notice.

You may send free messages only to friends in your Town. When using messages, you must not send content that constitutes any of the following: harassment or abuse; discrimination; obscene or sexually explicit content; other people's personal information; spam; advertising or solicitation; or impersonation of another person.

If you receive an unwanted message, you can block the sender by removing them from your Town ("remove from Town"); once removed, that person can no longer send you messages. To prevent abuse, you may send at most 10 messages per 24 hours.

You can also report any message or profile you find objectionable — such as harassment, abuse, or other violations of these Terms — from within the App. We review reports and, as a rule within 24 hours, take appropriate action, including removing the content and restricting, suspending, or removing the account of the offending user. There is no tolerance for objectionable content or abusive users.

The Operator does not routinely monitor the content of messages, but reserves the right to delete content and to restrict, suspend, or terminate the account of any user who violates these rules. Minors must not use the messaging feature inappropriately and should use it only with the consent of a parent or legal guardian.

Article 6 (Prohibited acts)

When using the App, the user shall not engage in any of the following:

Article 7 (Subscriptions, virtual items, and purchases)

The App may include a paid subscription ("Pro") and in-app items, namely sakura shells (the App's in-app points) and mock-test tickets ("virtual items").

Article 8 (Referral rewards)

Rewards granted through the referral feature may be subject to eligibility conditions and caps. Where fraud or a breach of these Terms is identified, the Operator may revoke rewards already granted, or change or discontinue the content and conditions of rewards.

Article 9 (Advertising)

The free version displays advertising via Google AdMob and similar services. For how advertising and tracking are handled, please see the Privacy Policy.

Article 10 (Intellectual property)

All copyrights, trademarks, and other intellectual property rights in the App and in the text, audio, images, design, source code, marks, and any other content contained in the App (collectively, the "Content") belong to the Operator or to the rightful rights-holders. Beyond private use, the user shall not copy, republish, modify, redistribute, sell, lend, or otherwise use the Content.

The App uses third-party materials under their respective licenses, including (see "Data Sources" in the App for attribution details): JMdict / KANJIDIC2 (CC BY-SA), HanziWriter (MIT), the JLPT vocabulary and grammar lists from tanos.co.uk (CC BY), and animCJK / Arphic (their applicable licenses).

Article 11 (Changes and suspension of the App)

The Operator may change the content of the App, or suspend or discontinue the provision of the App, without prior notice. The Operator's liability for any resulting damages is limited to the extent set out in these Terms.

Article 12 (Disclaimer)

The Operator makes no warranty whatsoever as to the completeness, accuracy, usefulness, or fitness for a particular purpose of the content of the App, which is provided "as is."

The predicted score and section estimates shown in the App are study aids intended only to help you gauge and plan your learning. They are estimates, not predictions of your result, and do not guarantee any outcome on the actual examination.

The Operator shall not be liable for any damages incurred by the user arising from use of, or inability to use, the App (including loss of data or sync failure). However, this disclaimer does not apply where the agreement between the user and the Operator constitutes a consumer contract under the Consumer Contract Act of Japan, or where the Operator has acted with intent or gross negligence.

Article 13 (Limitation of liability)

Even where the Operator is liable under the proviso of the preceding Article, except in cases of the Operator's intent or gross negligence, the Operator's liability is limited to the amount the user paid to the Operator (or to the store) in connection with the App during the most recent 12 months, and to direct and actual damages ordinarily arising.

Article 14 (Suspension and termination)

Where the user breaches these Terms, or where the Operator otherwise deems it necessary, the Operator may, without prior notice, restrict use of the App or suspend or terminate the account.

Article 15 (Privacy)

Handling of personal information and usage data in the App is governed by the separately defined Privacy Policy.

Article 16 (Governing law and jurisdiction)

These Terms shall be interpreted and applied in accordance with the laws of Japan. In the event of any dispute between the user and the Operator concerning the App, the court of jurisdiction over the location of the Operator's head office shall have exclusive jurisdiction as the court of first instance.

Article 17 (Changes to these Terms)

The Operator may revise these Terms when deemed necessary. Revised Terms take effect once posted on this page. For significant changes, we may provide notice within the App or in the store description.
